1. Your statutory warranty rights
At Green Cloud Nine, it is important to us that you receive products that correspond to their descriptions and are suitable for their intended purpose.
As a consumer, you have statutory warranty rights under Austrian law when purchasing our products. These rights exist independently of any voluntary guarantee and may not be restricted by our voluntary returns or service policies.
As a general rule, our products are subject to a two-year statutory warranty period from the date the goods are handed over to you.
2. When does the statutory warranty apply?
The statutory warranty protects you where a product was already defective at the time it was handed over to you or does not have the characteristics that you could reasonably expect.
For example, this may be the case where a product:
- does not correspond to the agreed or described characteristics;
- is not suitable for its intended purpose;
- has a manufacturing or material defect; or
- arrives damaged or otherwise defective.
The statutory warranty applies to defects that are attributable to a defect already existing at the time the goods were handed over.
3. What should you do if a product is defective?
If you discover a defect, please contact us as soon as reasonably possible.
Please email us at support@greencloudnine.com and, where possible, provide the following information:
- your order number;
- the name of the affected product;
- a brief description of the defect; and
- where helpful, photographs or other information that may assist us in assessing the problem.
We will review your case and inform you of the next steps.
Please do not return a product to us without first contacting us. We will let you know whether a return is required and, if so, how to proceed.
4. Presumption of defect within the first year
If a defect becomes apparent within one year of the goods being handed over to you, it is generally presumed that the defect already existed at the time of handover.
This presumption does not apply where it is incompatible with the nature of the goods or the nature of the defect.
5. What remedies are available to you?
If a product is defective, you are generally entitled in the first instance to rectification or replacement, provided the statutory requirements for this are met.
If rectification or replacement is not possible or reasonable, if the defect is not remedied within a reasonable period, or if remedying the defect would cause you significant inconvenience, you may, where the statutory requirements are met, be entitled to a price reduction or termination of the contract.We will work with you to determine the statutory remedy that applies in the particular circumstances.
6. Statutory warranty and withdrawal are not the same
Your statutory warranty rights and your right of withdrawal exist independently of one another.
Withdrawal:
If you wish to return an item ordered online within the statutory withdrawal period, without there being any defect, you may exercise your statutory right of withdrawal. Further information can be found in our [Withdrawal Policy].
Statutory warranty:
If a product is defective or does not correspond to the agreed or legally required characteristics, you may exercise your statutory warranty rights.
A defect therefore does not need to be dealt with under the right of withdrawal.
7. Our cosmetic products
Our cosmetic products are provided with the product information required by law.
In particular, please follow the information on the product packaging regarding shelf life, storage and the period after opening (PAO – Period After Opening) and use the product in accordance with those instructions.
The shelf life of a cosmetic product and statutory warranty rights are separate legal matters. The PAO symbol or shelf-life information shown on the packaging therefore does not replace or limit your statutory warranty rights.
Please note that proper storage and use of the product in accordance with the information on the packaging is important. Changes or damage resulting, for example, from improper storage or use after the goods have been handed over are not automatically defects covered by the statutory warranty.
8. Voluntary guarantees
A voluntary guarantee provided by the manufacturer or seller may give you additional rights. Such a guarantee is separate from the statutory warranty and does not restrict your statutory warranty rights.
Where an additional voluntary guarantee is offered for a particular product, we will provide information about it in the relevant product information.
